About these terms
ViralityWand is a social-content design and productivity tool, available as a web app, that helps you create carousel posts for social media. The tool drafts layouts and copy with AI assistance; you review, edit, and own the final result, and you decide what to publish. These Terms are the product licence between you and ViralityWand, operated by ViralityWand,Derenik Demirchyan St. 31, Yerevan, Armenia (“we,” “us,” “ViralityWand”). By using the service, you agree to these terms. Your purchase is also subject to the separate payment terms described below.
Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders, and handles payment, billing, refunds, and tax. When you buy a plan or top-up, your payment contract is with Paddle, and your purchase is also subject to Paddle’s Buyer Terms and Refund Policy. The product itself is licensed to you byViralityWand. Paddle.com (or Paddle.NET) will appear on your card or bank statement.
Subscriptions and AI tokens
ViralityWand is offered as a free plan and as paid monthly subscriptions ($8/mo for 100 AI tokens, $20/mo for 500 AI tokens), plus optional one-time “extra tokens” top-ups. One AI token permits one AI carousel generation. AI tokens are a limited, personal, non-transferable, revocable licence to use the service. They are not money, carry no cash value, and cannot be exchanged for cash.
- Subscription tokens are a monthly allowance: they reset at the start of each billing period and do not roll over to the next period.
- One-time top-up tokens are added to your balance and persist until used; they do not reset monthly.
- AI tokens are non-refundable once any token from a purchase has been used.
Paid plans auto-renew until cancelled (see our Refund & Cancellation Policy for the full renewal, cancellation, and refund terms).
Auto-renewal and cancellation
Paid plans renew automatically at the end of each billing period at the then-current price, until you cancel. The renewal term and price are shown before you subscribe. You can cancel any time, online, in a few clicks, via the “Manage subscription” link in your account or via Paddle at paddle.net — no phone call or email required. When you cancel, your plan stays active until the end of your current paid billing period; you keep access and any remaining tokens for that period, and you are not billed again. We do not give partial refunds or pro-rata refunds, and the current period is not refunded on cancellation.
Refunds and cancellation
Refunds and cancellation are governed by ourRefund & Cancellation Policy, which is incorporated into these terms by reference, and by Paddle’s Refund Policy. In summary: you can cancel online at any time; access continues to the end of the paid period; and all sales are final except for a 14-day satisfaction window on your first, unused purchase, any refund Paddle grants at its discretion, and your non-waivable rights under the law of your country of residence.
Immediate access and waiver of the cooling-off period
ViralityWand is digital content supplied immediately. When you subscribe or buy tokens, you expressly request immediate access and acknowledge that, by starting now — before the end of the 14-day cancellation period — you lose your statutory right to cancel and obtain a refund once the service has begun and any AI tokens have been used. This consent is presented to you as a separate, explicit checkbox at checkout and confirmed in your order email. Nothing in this section removes any non-waivable statutory right you have as a consumer under the law of your country.
Your content and licence to use the service
You own the content you create with the service. ViralityWand drafts material with AI assistance for you to review and edit; you are responsible for reviewing and editing generated content before publishing it. We grant you a non-exclusive, non-transferable licence to use the service for your own and your clients’ social content. We make no guarantee about the performance, reach, accuracy, originality, or virality of content created with the service.
Acceptable use
Your use of the service is governed by ourAcceptable Use Policy, which is incorporated into these terms by reference. In summary, you agree not to use the service to generate or distribute content that is illegal, infringing, defamatory, deceptive, hateful, harassing, or sexually exploitative, or that depicts a real person’s likeness without consent (no deepfakes or impersonation), or that violates a third party’s rights or any platform’s terms. You will not resell, scrape, reverse-engineer, bypass token limits, or use the service to build a competing product. You are responsible for all activity under your account and for complying with the laws of your country.
Eligibility and account
You must be at least 16 years old (or the age of digital consent in your country) to use the service. You agree to provide accurate account information, to keep your credentials secure, and to use one account for one user. You are responsible for all activity under your account.
Service provided “as is”
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law. The service depends on third-party AI providers and may be changed, suspended, or discontinued. We do not warrant that the service will be uninterrupted or error-free, or that content created with it will be accurate, original, or suitable for publication. Nothing in this section limits the statutory rights you have as a consumer under the law of your country.
Limitation of liability
To the maximum extent permitted by law, and except for liability that cannot be excluded under applicable law (including a consumer’s statutory rights, death or personal injury caused by our negligence, fraud, or gross negligence): (a) we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, even if advised of the possibility; and (b) our total aggregate liability arising out of or relating to the service in any 12-month period will not exceed the greater of the amounts you paid us (via Paddle) for the service in that period, or USD 50.
Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from content you create, publish, or distribute using the service, or from your breach of these terms or the Acceptable Use Policy.
Account suspension and termination
We may suspend or terminate your account, with or without notice, if you breach these terms or the Acceptable Use Policy, abuse refunds or chargebacks, use the service fraudulently, or where required by law or by Paddle. On termination for cause, you are not entitled to a refund of fees already paid, and any unused subscription AI tokens are forfeited. Any unused one-time top-up balance may be refunded at our discretion, pro-rata, to the extent required by applicable consumer law. You may stop using the service and cancel at any time.
Chargebacks
If you have a billing problem, please contact us or Paddle first — we resolve legitimate issues quickly. Raising a chargeback without first contacting us, or for a service you have used, may result in suspension or termination of your account.
Governing law and disputes
These terms (the product licence between you and ViralityWand) are governed by the laws of England and Wales, except that nothing in this clause deprives you of the protection of the mandatory consumer-law provisions of the country in which you are resident, or of your right to bring proceedings in your home jurisdiction where the law so allows. Your payment transaction with Paddle is governed by Paddle’s own terms.
Changes to these terms
We may update these terms. Material changes will be notified by email or in-app, and take effect from your next renewal or from your continued use after the change. If you do not agree, you may cancel before the change takes effect.
